TERMS OF SERVICE

These Terms of Service govern access to and use of the ProReach website and the purchase of products through the online store.

By using the website or placing an order, the customer agrees to these terms.

3.2 Eligibility

A customer must:

• Have legal capacity to enter into a binding agreement
• Provide accurate information
• Use the website lawfully
• Not misuse the website, checkout or payment systems

A minor must use the website with the assistance of a parent or legal guardian where required.

3.3 Product information

We take reasonable care to ensure product descriptions, dimensions, photographs, prices and specifications are accurate.

However:

• Product colours may differ slightly due to screens and lighting
• Packaging may change
• Measurements may be approximate
• Product improvements may result in minor specification changes
• Photographs may show accessories not included in the listed price

The product description and “what is included” section should be checked before ordering.

3.4 Product suitability

Customers are responsible for selecting a product suitable for their intended application.

ProReach may provide general guidance, but such guidance does not replace:

• A site assessment
• Professional engineering advice
• Occupational health and safety requirements
• Manufacturer instructions
• Applicable laws or workplace rules

The customer must disclose any unusual, specialised or high-risk intended use before purchasing.

3.5 Safety

Telescopic poles and attachments must be used responsibly.

Customers must:

• Read and follow all instructions
• Inspect equipment before each use
• Ensure attachments are securely connected
• Maintain a safe distance from people, vehicles and property
• Avoid overhead electrical lines and electrical installations
• Not use poles during lightning, excessive wind or unsafe weather
• Use suitable personal protective equipment
• Comply with workplace and occupational safety requirements
• Avoid use beyond the product’s intended application
• Stop using any damaged or unstable equipment

ProReach equipment does not eliminate all working-at-height risks. The customer remains responsible for conducting a suitable risk assessment.

3.6 Prices

All prices are displayed in South African rand.

ProReach is currently not VAT registered, and prices do not include VAT charged by ProReach.

Delivery charges, if applicable, are shown separately during checkout.

We may change prices without notice, but a change will not normally affect an order already accepted.

3.7 Errors

Where a product is listed with an obvious pricing, description or system error, ProReach may correct the error and contact the customer.

Where an order cannot reasonably be fulfilled because of an obvious error, ProReach may cancel the order and refund amounts paid.

This clause will not be used to avoid a valid agreement unfairly or contrary to consumer law.

3.8 Orders

Submitting an order is an offer to purchase.

An order is accepted when ProReach confirms acceptance or dispatches the goods, subject to applicable law.

We may refuse or cancel an order where:

• Payment is not authorised
• Stock is unavailable
• Delivery information is incomplete
• Fraud or misuse is suspected
• The order contains an obvious error
• Delivery is unavailable to the address supplied
• The transaction would be unlawful

Where a paid order is cancelled by ProReach, the relevant amount will be refunded.

3.9 Stock availability

Products are subject to availability.

Placing an item in a cart does not reserve stock.

Where an ordered product becomes unavailable, ProReach may:

• Offer an alternative
• Place the item on back order with the customer’s consent
• Refund the unavailable item
• Cancel and refund the affected order

3.10 Payment

Payment must be made using an available checkout method.

The customer confirms that:

• They are authorised to use the selected payment method
• Payment information supplied is accurate
• The transaction is lawful

Orders may be held until payment clears.

3.11 Delivery

Delivery is governed by the Shipping Policy published on the website.

Estimated delivery times are not guaranteed unless expressly agreed in writing.

3.12 Risk and ownership

Risk in the product passes in accordance with applicable law and the delivery arrangement.

Ownership remains with ProReach until full payment has been received.

3.13 Returns

Returns, exchanges and refunds are governed by the Return and Refund Policy.

Nothing in these terms excludes statutory rights.

3.14 Warranties

Products carry the warranties required by South African law and any additional written manufacturer or supplier warranty stated for the product.

A warranty does not generally cover misuse, unauthorised modification, normal wear and tear, impact damage or failure to follow instructions.

3.15 Limitation of liability

Nothing in these terms excludes liability that cannot lawfully be excluded.

To the extent permitted by law, ProReach is not liable for indirect, incidental or consequential loss arising from:

• Misuse of a product
• Failure to follow instructions
• Unsafe work practices
• Use near electrical hazards
• Use outside the product’s intended purpose
• Unauthorised modification
• Customer-supplied incorrect information
• Delay caused by events beyond our reasonable control

Any limitation will apply only to the extent permitted by South African law.

3.16 Website availability

We do not guarantee that the website will always be uninterrupted or error-free.

We may suspend or update the website for maintenance, security or operational reasons.

3.17 Prohibited conduct

Users may not:

• Use the website unlawfully
• Introduce malicious software
• Attempt unauthorised access
• Scrape or copy website content without permission
• Interfere with website operation
• Submit false orders or payment information
• Infringe intellectual property rights
• Use the website to commit fraud

3.18 Intellectual property

• The content is truthful
• They have the right to submit it
• It does not violate another person’s rights
• It is not unlawful, abusive or misleading

The customer grants ProReach permission to display and use the content for reasonable business and marketing purposes, unless otherwise agreed.

3.21 Force majeure

ProReach is not responsible for delay or failure caused by events beyond its reasonable control, including severe weather, strikes, civil disruption, transport interruption, system failure, import delays, supplier failure or government action.

We will take reasonable steps to minimise the impact.

3.22 Governing law

These terms are governed by the laws of the Republic of South Africa.

Disputes will be dealt with by a court or consumer dispute-resolution body with lawful jurisdiction.

3.23 Changes to these terms

We may update these terms from time to time.

The terms applicable to an order are generally those published when the order was placed, unless a legal or necessary change applies.
